Terms of Use “My d&b”

1. Scope of Application / Reservation of the Right of Modification

The following Terms of Use shall apply to the use of the My d&b environment (including the user login) on the d&b Websites (“My d&b”) operated by d&b audiotechnik GmbH & Co. KG ("d&b") and the contents, documents and functions ("contents") contained and provided therein.

My d&b is for professional d&b users, end-customers and partners (“user”). Whether the user is a system integrator, sound engineer or designer, technician, foh, consultant, distributor, dealer, sales partner, service provider, or other professional user, My d&b helps to get access to all information about d&b products and services. Subject to the provisions of these Terms of Use, user may use My d&b free of charge according to these Terms of Use. The use of certain contents or functions may be subject to special provisions. These separately shown provisions shall then apply each time in addition to these Terms of Use. If the use of contents or functions triggers payment obligations (e.g. Merchandise Shop, paid services), these costs shall be shown separately for the respective contents or functions.

d&b shall reserve the right to modify the Terms of Use at any time and to make further use of My d&b dependent on approval of the changed Terms of Use.

2. Copyright

The contents provided in My d&b are copyright-protected. Any utilization of contents over and beyond the scope of use shown for the respective contents shall require prior written approval (text form is sufficient) by d&b.

3. Provision of Contents and Functions

d&b shall reserve the right to change, terminate or remove all or some of the contents and functions at any time, and/or to stop operating My d&b entirely at any time.

d&b shall not guarantee that My d&b is available at all times.

4. Liability

1. d&b shall only be liable for material defects (e.g. bugs and other faults) and legal defects in My d&b (defect warranty) if d&b has maliciously concealed the defect. d&b shall not assume any other explicit or tacit warranty or guarantee regarding the results, quality, performance, functionality or accessibility of My d&b.
2. Apart from the defect warranty, d&b shall only accept liability in cases of intent and gross negligence, as well as in cases of mandatory legal liability.
3. All other liability of d&b shall be excluded.
4. To the extent to which the liability of d&b is restricted or excluded in accordance with the above conditions, this shall also apply to the personal liability of the legal representatives and employees of d&b, as well as to indirect damage and subsequent damage (e.g. loss of data, damage to your hardware or software, business interruptions, loss of production, lost profit).

5. Registration / Deregistration

The user shall register an account in order to gain access to the My d&b.

To log in into My d&b the user has to enter its login information. The login information consists of user’s personal email address and personal password (as specified during the My d&b account registration).

The information registered by the user may be changed or updated at any time in the user's account. This provision shall not apply to master data (name, company, e-mail address).

The user shall be responsible for ensuring that third parties cannot access his/her password. The user shall be fully responsible for all actions, which are performed using his/her login name in conjunction with his/her password.

If the user discovers that his/her login name/registration data are being misused, he/she shall inform d&b immediately and stop this misuse by changing the login information.

In order to delete the My d&b account, the user shall go to https://www.dbaudio.com/global/en/my-db/account-settings/

In the My d&b menu 'Account settings' the user can delete its account by clicking on 'Close My d&b account'.

d&b shall be entitled to delete an account after giving the user a period of notice of 2 weeks. d&b shall inform the user about the imminent deletion of his/her account by sending an e-mail to the user's stored e-mail address.

If the user infringes these Terms of Use, d&b shall be entitled to delete the user's account without prior announcement. d&b shall also reserve the right to enforce compensation claims against the user.

6. Data Protection

7. Miscellaneous

1. All disputes, differences of opinion or claims arising from or in connection with this Terms of Use, its infringement, termination or invalidity, or relating to the use of the My d&b, shall be subject solely to German law to the exclusion of the conflict-of-law rules. The UN Convention on the International Sale of Goods (CISG) shall not apply. The sole place of jurisdiction for all disputes arising from or in connection with this User Agreement shall be Stuttgart.
2. If individual clauses of these Utilization Conditions are wholly or partially invalid or unenforceable, the validity of the other clauses shall not be affected.
3. Conflicting or different General Terms and Conditions or agreements shall only apply if d&b has expressly approved them in writing.
